REDPASS LLC, operating myfanzi.com, qualifies as a “Service Provider” within the meaning of 17 U.S.C. § 512(k)(1) of the Digital Millennium Copyright Act (DMCA). Accordingly, it is entitled to certain protections from claims of copyright infringement under the DMCA, commonly referred to as the “safe harbor” provisions. We respect the intellectual property of others and ask our users to do the same. This Notice and Takedown Policy outlines our compliance with the DMCA and the steps for reporting copyright infringement.

 

How to Submit a Notice of Claimed Infringement

 

If you believe your work has been copied and published on myfanzi.com in a way that constitutes copyright infringement, please provide our Designated Agent with the following information:

 

1. An electronic or physical signature of the person authorized to act on behalf of the copyright owner;

2. A description of the copyrighted work that you claim has been infringed;

3. A description of where the material that you claim is infringing is located on myfanzi.com (preferably including specific URLs);

4. Your name, address, telephone number, and email address;

5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and

6. A statement, under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Abuse Notification

 

Misrepresenting facts in a DMCA Notice or counter-notification can result in legal liability for damages, court costs, and attorney’s fees under federal law. See 17 U.S.C. § 512(f). Ensure all claims are accurate and made in good faith.

 

How We Respond to Takedown Notices

 

Upon receiving a valid DMCA Notice, myfanzi.com will:

 

1. Remove or disable access to the allegedly infringing material.

2. Notify the affected user.

3. Allow the user to submit a counter-notification if they believe the material was removed due to an error or misidentification.

 

We act expeditiously to address valid DMCA claims and will terminate repeat copyright infringers when appropriate.

 

How to Submit a Counter-Notification

 

If you believe your material was removed or disabled due to a mistake or misidentification, you may submit a counter-notification containing:

 

1. A description of the removed or disabled material and its location on myfanzi.com before removal.

2. A statement under penalty of perjury that you have a good faith belief that the removal was erroneous. Example:

“I swear, under penalty of perjury, that I have a good faith belief that the material was removed as a result of mistake or misidentification.”

3. Your name, address, telephone number, and email address.

4. A statement consenting to the jurisdiction of the federal district court where you are located or where myfanzi.com operates, and that you will accept service of process from the complainant.

Response Timeline

 

After receiving a valid counter-notification, myfanzi.com will:

 

1. Notify the complainant of the counter-notification.

2. Restore or re-enable access to the content within 10-14 business days, unless the complainant provides proof of court action to restrain the allegedly infringing activity.

 

Language and Modifications

 

• All DMCA Notices and counter-notifications must be in English. Notices in other languages will not be processed.

• myfanzi.com reserves the right to modify or update this policy.
